Terms of Service

These Terms govern your use of smartcharts.co (the "Service"), operated by Smart Charts. By creating an account or paying for a subscription, you agree to these Terms. If you don't agree, please don't use the Service.

Important — not financial advice. Smart Charts is investment research and education. Nothing on the Service is personalized investment advice, a recommendation to buy or sell any security, an offer to sell securities, or a solicitation. All decisions are yours alone. Past performance does not guarantee future results.

1. The Service

Smart Charts provides stock fundamentals, screening tools, the proprietary "Buy Zone" composite, tracking of public 13F filings and U.S. Congress trade disclosures, macro indicators, paper-trading tools, and related research surfaces. All data shown is sourced from third-party providers (including Yahoo Finance, Financial Modeling Prep, the SEC, and the Federal Reserve) and computed by our own logic.

2. Eligibility and account

You must be at least 16 years old to use the Service.
You must provide accurate account information and keep it up to date.
You're responsible for activity that occurs under your account. Don't share credentials.
One person, one account. Don't create multiple accounts to evade limits or bans.

3. Subscription, free trial, and billing

New paid subscriptions include a free trial of the length stated at signup (currently 7 days).
After the free trial, your subscription automatically renews at the price stated at signup. Pricing may change with at least 30 days' notice; existing subscribers keep their current price for the remainder of any pre-paid period.
Billing is handled by Stripe. Refunds are at our discretion; cancellations stop future renewals but don't refund the current period unless required by applicable law.
You can cancel anytime from your account billing portal. Access continues until the end of the paid period.

4. Acceptable use

You may not:

Resell, sub-license, or redistribute the Service or its data to third parties.
Use automated scraping, crawling, or bots beyond normal browser use, or attempt to bypass rate limits.
Reverse-engineer the Service, the Buy Zone logic, or any underlying systems.
Use the Service to send spam, malware, or to harass other users.
Attempt to gain access to accounts, data, or systems you're not authorized to use.

5. Data accuracy and freshness

We work hard to display accurate, timely data — but the Service depends on third-party sources that occasionally have errors, delays, or outages. Specifically:

Price data may be delayed (typically 15 minutes outside market hours; near real-time during the U.S. session).
Fundamentals from 10-K and 10-Q filings can be revised by issuers; we display the latest reported version.
13F filings are quarterly snapshots with a ~45-day lag — they do not reflect intraday positioning.
Congress trade data comes from disclosures filed under the STOCK Act and may be incomplete or delayed.
The Buy Zone composite is a model output, not a guarantee. It can be wrong.

If you spot a data error, please report it via the in-app "Report glitch" button.

6. Intellectual property

The Smart Charts name, logo, content, code, and aggregations are owned by Smart Charts. The Buy Zone composite is proprietary; while we publish the framework's intent, the exact gating logic is our intellectual property. Third-party data is licensed from our providers and remains theirs.

You retain ownership of content you submit (watchlist, paper trades, feedback). By submitting feedback or bug reports, you grant us a non-exclusive right to use it to improve the Service.

7. AI features

Some product surfaces ("AI Insights", in-product chat) use large language models to generate text. AI output is provided as commentary on underlying data, may be wrong, and is never personalized investment advice. We don't train external AI models on your private data; the Anthropic API processes your queries under their own terms.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL BE ACCURATE OR COMPLETE.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SMART CHARTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOST OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions don't allow the exclusion or limitation of certain damages — in those places, parts of this section may not apply to you.

10. Indemnification

You agree to indemnify and hold Smart Charts harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your use of the Service.

11. Termination

We may suspend or terminate accounts that violate these Terms, with or without notice depending on severity. You can terminate your account at any time. On termination, your access stops and most account data is deleted within 30 days, subject to retention required by law (see Privacy Policy).

12. Changes to these Terms

We may update these Terms. Material changes will be announced via email or in-product notification, and the new Terms take effect on the date stated in the announcement. Continued use after that date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Texas, and you consent to that jurisdiction. If a court finds any provision of these Terms unenforceable, the rest remains in effect.
